GENERAL TERMS AND CONDITIONS
Article 1. Definitions
– HRC CULINARY ACADEMY, based in Sofia, Bulgaria, an international hospitality school, hereinafter referred to as HRC
– STUDENT(S), anyone who contacts HRC for educational services HRC offers, hereinafter referred to as STUDENT
– TUITION FEE(S), an amount of money which needs to be paid to HRC for the services HRC provides (see article 2).
– SERVICE(S), all acts performed by HRC on behalf of the CANDIDATE
Article 2. Services of HRC
HRC provides educational programs in culinary arts, food & beverage, and hospitality, HRC also assists foreign students with relevant procedures and formalities prior to departure to Bulgaria, as well as assists students with internships abroad.
Article 3. Liability
HRC accepts no liability for damages incurred before, during and/or after the study program and or SERVICE, including any internship arranged by HRC. HRC has exemplified that it cannot and will not accept any responsibility for either the nature, length and/or contents of the study program or internship, nor the work conditions and does not have any influence over the decisions made by the EMPLOYER concerning these matters. HRC, however, is obliged to arrange the study program, as well as internship(s), and all related items to the best of its ability and in the STUDENT’s best interest.
Article 4. Accepting these terms and conditions
STUDENT agrees to the terms and conditions as outlined in this document. These terms and conditions are also available online at www.hrcacademy.com/en/general-terms
Article 5. Payments
HRC charges tuition fees to the STUDENT for the study programs offered. Tuition fees are either paid per semester or per year (depending on the STUDENT’s visa status), and should be prior to the actual start of each semester/year.
For late payments of the tuition fee, HRC may charges a penalty fee. If STUDENT fails to pay the tuition fee in time, the study program may be terminated by HRC. In addition, STUDENTS from outside the EU may have their visa cancelled and these STUDENTS risk having to leave the country immediately.
Following refund policies apply for STUDENTS from outside the EU:
If the Student decides to terminate his or her relationship with HRC Culinary Academy for any reason, his/her Bulgarian visa D will be cancelled.

All applicable refunds will be processed within one month of the Student’s notice of termination.
Article 6. Commercial use of data
HRC takes STUDENT’S privacy very serious and will process, store and use STUDENT’S data in a safe way. HRC has drawn up privacy rules (hereafter called: “Privacy Statement”), which contents STUDENT can read below. HRC recommends STUDENT to read this carefully.
HRC collects personal data as supplied by STUDENT (hereinafter called: “Personal Data”), so HRC can advise, assist and provide STUDENT with study programs in the field of hospitality and cuisine, including finding a paid internship abroad if part of the study program. STUDENT’S data may be internally linked to one or several internship vacancies by HRC’s career services. These services, including HRC’s website (s), are called “Service” hereinafter. In the performance of its service HRC makes use of agents and associates. All parties involved act in compliance with this Privacy Statement.
In order to make use of the Services HRC offers STUDENT, one has to compose a personal profile or HRC makes a profile for STUDENT. For creating this personal profile STUDENT must provide certain Personal Data. After these data have been supplied, a profile is drawn up automatically. This profile contains the information STUDENT has declared during the composition of the personal profile. STUDENT is able to deactivate CANDIDATE’S data at any time or have them removed by HRC.
HRC also collects information on STUDENT’S surfing behavior being generated automatically during the use of HRC’s Service and HRC’s website(s). This information contains among others STUDENT’S IP-address (the number of STUDENT’S computer which enables to identify STUDENT’S computer), the date of filling in the Personal Data and “cookies”. As far as this information is used by HRC , it will always be anonymously.
For the implementation of the Service HRC makes use of cookies that are stored on STUDENT’S computer by STUDENT’S browser. Cookies are small pieces of information which HRC’s server sends to STUDENT’S browser with the intention that this information will be sent back to HRC’s server in a subsequent visit. These small files are stored on the hard disk or in the memory of STUDENT’S computer. Cookies cannot damage STUDENT’S computer or the files on STUDENT’S computer.
In the cookies information is stored (such as the setup of STUDENT’S PC, preferences specified by STUDENT and the leads and discussions to which STUDENT is subscribed) for facilitating a subsequent use of the service. This information contains, apart from STUDENT’s IP address, no name or address data nor any other Personal Data. STUDENT can set STUDENT’S browser such way, that STUDENT will receive no cookies during the next use of the Service. In that case it might happen that STUDENT cannot make use of all opportunities of the Service or that STUDENT has no access to (parts of) the Service. For more information on these functions, STUDENT can best seek STUDENT’S browser instructions or the help key of STUDENT’S browser. If STUDENT want to make use of cookies, STUDENT needs to log out before leaving a public computer.
The websites of HRC make use of Google Analytics, a web analysis service offered by Google Inc. (“Google”). Google Analytics uses cookies in order to help analyzing the website(s) who users are using the site. The information generated by the cookies about STUDENT’S use of the website (including STUDENT’S IP-address) is forwarded to – and stored by Google on servers in the United States. Google uses this information to monitor how STUDENT use the website, to report on the website activity for website operators and to offer other services in relation to website activities and the use of the internet. Google may provide this information to third parties if Google is legally obliged to this end, or as far as such third parties process the information on behalf of Google. Google will not combine STUDENT’S IP address with other information being at their disposal. STUDENT can refuse to use cookies by choosing the appropriate settings at STUDENT’S browser. HRC would like to remind STUDENT, however, that STUDENT might not be able to benefit all opportunities of this (these) website(s), HRC’s Service in that case. Making use of this website STUDENT gives permission for the processing of information by Google in the manner and for the purposes as described above.
To grant the Service to STUDENT;
To send STUDENT information on the services of HRC itself;
To draw up anonymous statistical data and to make the Service safer; To provide STUDENT’S information to third parties based on the legal obligations; In order to adapt and improve the Service.
HRC uses automatically generated data for statistical purposes as well as for security and improvement of the website (s) and the Service. This information can be supplied to third parties so far as they are completely anonymized and cannot be linked to STUDENT personally. No Personal Data are supplied.
Without CANDIDATE’S explicit permission HRC will not provide third parties with STUDENT’S Personal Data, not even for direct marketing purposes (for example for sending STUDENT special offers). HRC is allowed to provide third parties with STUDENT’S data as far as this is necessary for the granting the service to STUDENT and/or as far as these data cannot be linked to STUDENT personally (such as automatically generated information, not being STUDENT’S IP address). Finally, HRC can provide STUDENT’S data to third parties if this is required on the basis of legal provisions, or as a result of a trial and/or if one considers it to be necessary to protect one’s own rights.
HRC will process STUDENT’S Personal Data in a proper and careful manner, in accordance with the Bulgarian law. HRC requires that STUDENT provides the data marked with an asterisk (*). It is not required to have the data completed not marked with an asterisk (*). HRC will take appropriate technical and organizational measures in order to protect STUDENT’S Personal Data against loss or against any form of unlawful processing.
HRC will not keep the Personal Data longer than necessary, at which HRC strives for a constructive, long-term relationship. However, STUDENT can deactivate STUDENT’S data at any time or having them removed by us.
As far as the personal data are forwarded to third parties in accordance with this Privacy Statement, and these third parties are established outside the European Union, forwarding of data only takes place if that country ensures an appropriate security level, or, if forwarding is necessary for the implementation of the agreement or agreements between STUDENT and HRC, or for taking pre-contractual (ie student visa/permit) measures in response to a request from STUDENT and which are necessary for the conclusion of an agreement. By using the Service STUDENT give STUDENT’S active consent to forward the data, within this framework, outside the European Union.
It may happen that one or more parts or assets of the owner of HRC are transferred to a third party or that HRC merges with a third party. In this case also STUDENT’S Personal data can be transferred. In the event of transfers uniform conditions apply. If the conditions however unexpectedly change in STUDENT’S disadvantage, STUDENT’S consent will be asked first. If desired STUDENT can have CANDIDATE’S data deactivated or having them removed by HRC.
This Privacy Statement solely applies to Personal Data that have been obtained via the website www.hrcacademy.com and other websites used by HRC . The website(s) may contain links to other websites of third parties. HRC does not accept any responsibility nor liability for (the operation and/or content of) websites or services of third parties.
Principally HRC is intended for persons at the age of 18 (eighteen) or older. If CANDIDATE is under the age of 18 (eighteen) CANDIDATE is allowed to apply for studies at HRC, however CANIDATE must be 18 (eighteen) or older at the actual start of the studies. By agreeing with this Privacy Statement, HRC supposes that CANDIDATE is really 18 (eighteen) years old or older.
This Privacy Statement can be altered. The changes are publicly made available on the website.

HRC’s online service is committed to protecting the privacy of our users. We want to provide a safe and secure user experience. We will share your information within the HRC group of companies and partner organizations where necessary in order to provide you with our career development services.
• Your CV and related information will be sent to prospective host employers to organize your internships, but only where you give your consent.
• We may also release information relating to you to regulatory or law enforcement authorities, if required to do so. We also reserve the right to disclose the information we have collected about you to our professional advisors and to other persons to the extent that HRC contracts out any aspect of the operation of its services. These third parties will be acting under similar undertakings of confidentiality as HRC.
• In the event that HRC would merge or be acquired by another business, we may share the information that relates to you with the new owners of the business and their advisers.

You may not use the HRC Academy Site for any of the following purposes:
• disseminating any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material or otherwise breaching any laws;
• transmitting material that encourages conduct that constitutes a criminal offense, results in civil liability or otherwise breaches any applicable laws, regulations or code of practice;

• The suspension or cancellation of your registration and your right to use the HRC Academy Site shall not affect either party’s statutory rights or liabilities.
We gather information and statistics collectively about all visitors to this website, for example, which area users’ access most frequently and which services users’ access the most. We only use such data in the aggregate form. This information helps us determine what is most beneficial for our users and how we can continually improve our online services to create a better overall experience for our users.

HRC makes no representation or warranty in respect of any of the following:
• the existence or availability of any appointment advertised on the HRC Academy Site;
• that any host employer will ask for your CV, ask to interview you with regards to your internship;
• that any host employer will keep confidential any of your information or data provided to that host employer; or
• the final terms and duration of any appointment obtained through the HRC Academy Site.
We cannot guarantee that the service will be fault-free. If a fault occurs in the service you should report it to info@hrcacademy.com and we will attempt to correct the fault as soon as we reasonably can. If HRC is informed of any inaccuracies in the material on the HRC Academy Site we will attempt to correct the inaccuracies as soon as we reasonably can.
Your access to the HRC Academy Site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore the service as soon as we reasonably can.
All information incorporated within the HRC Academy Site is owned or licensed by HRC Academy. These terms and conditions will be subject to the laws of the Bulgaria. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement, and you want to take court proceedings, you must do so within the Bulgaria.
Whilst HRC uses reasonable care in compiling and presenting the content found on the HRC Academy Site, it is provided purely for information and you should seek further guidance and make independent enquiries before relying upon it. If HRC is informed of any inaccuracies in the material on the HRC Academy Site we will attempt to correct the inaccuracies as soon as we reasonably can. If we are in breach of these Terms and Conditions, we will only be responsible for any losses that you suffer to the extent that they are a foreseeable consequence to both of us. Our liability shall not in any event include business losses such as lost data, lost profits or business interruption. These Terms and Conditions shall not limit or affect our liability if something we do negligently causes death or personal injury.
You may not transfer any of your rights under these Terms and Conditions to any other person. We may transfer our rights under these Terms and Conditions to another business where we reasonably believe your rights will not be affected. If you breach these Terms and Conditions and HRC chooses to ignore this, HRC will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.
